General Terms and Conditions – Holiday Apartment Rental (English Version)
These General Terms and Conditions apply to all contracts concerning the temporary rental of our holiday apartments. The agreement constitutes a temporary accommodation / holiday rental contract under German law (Sections 535 et seq. of the German Civil Code – BGB).
1. Conclusion of the Contract
1.1 The rental contract is concluded once the booking has been confirmed in writing by the landlord (by email or via the website).
1.2 The holiday apartment is provided exclusively for temporary recreational purposes. Permanent residence, registration of address or any other use is not permitted.
1.3 The apartment may only be occupied by the number of persons stated in the booking and confirmed by the landlord. Overnight visitors are considered additional guests.
1.4 The landlord is entitled to request the presentation of a valid official identification document upon arrival.
1.5 Subletting or making the apartment available to third parties is not permitted without the prior written consent of the landlord.
1.6 All prices include statutory VAT and ancillary costs such as electricity, water, heating and final cleaning, unless expressly stated otherwise.
2. Arrival and Departure
2.1 On the day of arrival, the holiday apartment is available from 2:00 p.m.
2.2 On the day of departure, the apartment must be vacated no later than:
- 10:00 a.m. in Rodelhaus and Sankt Andreasberg;
- 10:30 a.m. in Lerbach, Lonau and Wieda.
2.3 Deviations from the stated arrival or departure times require prior written approval from the landlord.
3. Payment Terms
3.1 Upon receipt of the booking confirmation, a deposit of 50% of the total rental price is due.
3.2 The remaining 50% of the rental price must be paid no later than 30 days before the start of the rental period.
3.3 If payments are not made on time, the landlord is entitled to withdraw from the contract.
4. Cancellation by the Tenant
4.1 Cancellation of the rental contract must be made in writing.
4.2 In the event of cancellation, the following cancellation fees apply:
- up to and including 31 days before the start of the rental period: 0% of the total rental price;
- from 30 days before the start of the rental period: 100% of the total rental price.
4.3 Payments already made will be credited against the cancellation fees.
4.4 The decisive date is the date on which the written cancellation is received by the landlord.
4.5 The tenant is strongly advised to take out appropriate travel cancellation insurance.
5. Withdrawal by the Landlord
5.1 The landlord is entitled to withdraw from the contract if:
- agreed payments are not made on time;
- force majeure or unforeseeable circumstances (such as natural disasters, pandemics, official orders or technical failures) make performance of the contract impossible;
- the tenant has provided false or misleading information;
- the tenant or accompanying persons seriously violate these terms and conditions or the house rules.
5.2 In the event of justified withdrawal by the landlord, there is no entitlement to compensation.
6. Use and House Rules
6.1 The tenant undertakes to treat the holiday apartment and its furnishings with due care.
6.2 Quiet hours apply daily from 10:00 p.m. to 7:00 a.m.
6.3 When leaving the apartment, windows and doors must be closed and electrical appliances and lighting switched off.
6.4 Waste must be separated and disposed of in accordance with local regulations.
6.5 Smoking is not permitted inside the apartment. Smoking is only permitted on the terrace.
6.6 Charging of electric vehicles on the property is not permitted.
6.7 Additional guests must be registered in advance. A surcharge of EUR 15.00 per person per night may be charged for additional guests.
6.8 The installation of decorations or fastening materials is not permitted.
6.9 Serious or repeated violations of the house rules may result in immediate termination of the rental contract.
7. Handover and Security Deposit
7.1 Upon departure, the holiday apartment must be left in a broom-clean condition.
7.2 Any damage or additional cleaning costs may be offset against the security deposit.
8. Liability
8.1 The landlord is liable for the contractual provision of the holiday apartment.
8.2 The tenant is liable for any damage caused by themselves, accompanying persons or pets.
8.3 The landlord assumes no liability for personal belongings brought by the tenant.
8.4 Liability for interruptions in utility services and for force majeure is excluded.
9. Data Protection
Personal data is processed exclusively for the purpose of performing the contract and is treated confidentially.
10. Final Provisions
10.1 Should individual provisions of these terms and conditions be or become invalid, the validity of the remaining provisions shall remain unaffected.
10.2 German law shall apply exclusively.
10.3 The place of jurisdiction and place of performance is the registered office of the landlord.
