General terms and conditions:
1. Conclusion of contract The contract is considered binding when the holiday apartment is ordered and confirmed and/or made available at short notice. The booking is made in written form. The holiday apartment is available to the tenant for the contract or Rental period exclusively for use for holiday purposes. The apartment can only be occupied by the people registered in the booking. You may be asked to present your ID card upon arrival. Subletting is not permitted. All prices include the respective statutory VAT. The rental price includes additional costs such as electricity, water, heating and final cleaning.
2. Arrival and departure The holiday apartment is available to the tenant from 2 p.m. on the day of arrival. On the day of departure, the apartment should be returned to the host no later than 10:00 a.m. at Rodelhaus and Sankt Andreasberg, 10:30 a.m. at Lerbach, Lonau and Wieda. Special requests or additional arrangements for arrival and departure are generally possible. They require written confirmation from the landlord.
3. Payment A deposit of 50% of the rental price is due with the booking confirmation. The remaining 50% of the rental price is due 30 days before departure.
4. Withdrawal by the tenant You can withdraw from the contract at any time. The withdrawal must be made in writing. In the event of cancellation before the start of the contract, the tenant will be charged the following cancellation fees. Until the 31st day 0% of the total rental price. From the 30th day before the start of the rental, the full rental price (100%) must be paid. Amounts that have been paid will of course be taken into account and credited. The basis for calculation is the day on which the cancellation is received by the landlord. In order to avoid cancellation fees, we recommend taking out travel cancellation insurance.
5. Withdrawal by the landlord The landlord is entitled to withdraw from the contract if the agreed payment is not made on time. Furthermore, the landlord is entitled to withdraw from the contract extraordinarily for objectively justified reasons, such as: force majeure, unforeseeable events, pandemics and lockdowns in the event of circumstances beyond his control that make the fulfillment of the contract by the landlord impossible, in the event of misleading or false information provided Facts of the tenant such as name or purpose in the event of behavior contrary to the contract, which is unreasonable. In the event of a violation of the house rules, the tenant must immediately inform the tenant of the exercise of the withdrawal if the above facts arise. There will be no compensation if the landlord withdraws with justification.
6. House rules The tenant undertakes to treat the holiday apartment and its inventory provided to him with care. Tenants are asked to show mutual consideration. The night quiet applies from 10 p.m. to 7 a.m. During this time, special consideration for roommates and neighbors is required. TV and audio devices should be set to room volume.
For the duration of the rental of the holiday apartment, the tenant is obliged to keep windows and doors closed when leaving the holiday apartment, to set all radiators to a low level and to turn off lights and technical devices. Please use the house in an environmentally and cost-friendly manner and pay attention to your electricity, heating and water consumption.
Please separate your garbage into plastic (yellow bags), paper, glass, green and rest. Do not use organic bags in the green bin. Smoking is not permitted in the apartment.
Smokers are allowed to smoke on the terrace.
Charging electric vehicles is not permitted on the property because the technical requirements are not met. …Violations of this agreement will result in the immediate termination of the rental agreement without any entitlement to a refund of the rental amount
If you bring more guests than stated on your reservation, you are obliged to report them and pay €15 per person per night. Violations of this agreement will result in the immediate termination of the rental agreement without any entitlement to a refund of the rental amount.
The payment and/or Attaching materials for decoration or similar is not permitted in the holiday apartment.
To get the deposit back, it is important that you leave the house tidy. Here is a clear checklist so that you too can get your deposit refunded. Is the house broom clean? Has the waste been sorted as agreed? Dispose of household waste in the appropriate bins Are the dishes done? BBQ and fireplace clean again Use bedding! If you have forgotten your own bedding, you can always order additional bedding. Remove bed linen and put it in the bathroom Has your pet been lying on the couch? Then please make the sofa hair-free again. Is all the furniture back where you found it? Are all windows closed? Are all the lights off? Is the door locked? Is the key in the key box? Did something break? It can happen, we are all human, but please report it.
7. Liability The landlord is liable for the proper provision of the agreed services and for the accuracy of the description of the rental property. The holiday apartment will be handed over to the tenant in a clean and contractual condition. Any defects that may exist must be reported to the landlord immediately. The tenant is 100% liable for damage caused through his own fault. The tenant undertakes to report any damage caused by him to the landlord immediately. The landlord is not liable for items brought in by the tenant. Parents are obliged to exercise their duty of care towards their children, otherwise there is no liability claim against the landlord. Liability for possible failures or disruptions in the water or electricity supply, as well as events and consequences caused by force majeure are hereby excluded. Likewise, no liability is assumed if unforeseeable or unavoidable circumstances occur, such as official orders, sudden construction sites or disruptions caused by natural and local events.
8.Data protection The tenant agrees that necessary data about himself will be stored, changed and / or deleted as part of the contract concluded with him. All personal data is treated with absolute confidentiality. Final provisions Should one or more provisions of these terms and conditions be or become ineffective, this will not affect the effectiveness of the remaining conditions. The ineffective regulation must be replaced by an effective one that comes closest to the economic and legal will of the contracting parties. German law applies. The place of jurisdiction and place of performance is the landlord’s place of residence.
